MycoTest operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you, the customer, with our products and services (the “Services”). MycoTest is powered by Shopify, which enables us to provide the Services to you.
This Privacy Policy describes how MycoTest collects, uses, discloses, and otherwise processes your personal information when you visit or use the Services, purchase a product, submit an environmental sample for laboratory analysis, request an optional contractor referral, or otherwise communicate with us.
If there is a conflict between our Terms of Service and this Privacy Policy concerning the collection, use, processing, or disclosure of personal information, this Privacy Policy controls.
Please read this Privacy Policy carefully. By accessing or using the Services, you acknowledge that you have read and understand the practices described in this Privacy Policy.
Personal Information We Collect or Process
“Personal information” means information that identifies you or can reasonably be linked to you or another person. It does not include information that is anonymous or deidentified so that it cannot reasonably be linked to an individual.
Depending on how you interact with the Services, where you reside, and what applicable law permits or requires, we may collect or process the following categories of personal information:

Contact information, including your name, email address, telephone number, billing address, shipping address, and, when provided, the address of the property associated with an environmental sample or referral request.

Payment and transaction information, including payment method, payment confirmation, transaction details, products purchased, returns, exchanges, cancellations, and order history. Payment card information is generally processed by Shopify and its payment providers. MycoTest does not intentionally store complete payment card numbers.

Account information, including your username, password, preferences, settings, and other information associated with your account.

Environmental testing information, including order and sample identification numbers, the type of environmental test ordered, information you provide about a sample or property, sample submission and chain of custody information, laboratory status, laboratory reports, and test results.

Referral information, including whether you requested an optional contractor referral, the type of environmental service requested, your referral consent selections, the contractor matched to the request, the date information was disclosed, and records relating to referral withdrawal or deletion requests.

Communications, including information you provide when contacting customer service, submitting a question, requesting a referral, or otherwise communicating with us.

Device information, including information about your device, browser, network connection, IP address, and other online identifiers.

Information We Do Not Request
MycoTest does not request or require blood, tissue, saliva, genetic material, or other biological samples collected from a person. We also do not request or require medical symptoms, diagnoses, medical histories, treatment information, health insurance information, or other personal medical information.
Please do not submit personal medical information with an order, environmental sample, referral request, or customer service communication. If you voluntarily provide personal medical information, MycoTest will not include that information in a contractor referral or disclose it to a remediation contractor.
Sources of Personal Information
We may collect personal information from the following sources:

Optional Contractor Referrals
When you affirmatively request a referral, we may use the information you authorized to identify and connect you with an independent environmental or remediation contractor serving your area. Marketing and Advertising
We may use personal information for marketing and promotional purposes, including sending promotional communications by email, text message, or postal mail and displaying advertisements on our website or other websites. Where required by law, we will obtain consent before sending marketing communications.
Security and Fraud Prevention
We may use personal information to authenticate accounts, provide a secure shopping experience, detect and investigate potentially fraudulent, illegal, unsafe, or malicious activity, protect our customers and the public, and maintain the security of the Services.
Communicating With You
We may use personal information to respond to questions, provide order and sample updates, deliver laboratory results, provide customer support, administer referral requests, and maintain our business relationship with you.
Legal and Business Purposes
We may use personal information to comply with applicable law, respond to valid legal process, enforce our terms and policies, investigate potential violations, resolve disputes, participate in legal proceedings, and protect the rights, property, and safety of MycoTest, our customers, and others.
How We Disclose Personal Information
We may disclose personal information in the following circumstances and for the purposes described in this Privacy Policy:

Shopify and payment providers. We disclose information to Shopify and payment service providers to host and operate the store, process transactions, provide store features, prevent fraud, and support the Services.

Independent laboratories. We disclose information reasonably necessary to register, track, receive, and analyze environmental samples and to generate and deliver laboratory reports. Whenever reasonably practicable, samples are identified using order or sample identifiers rather than unnecessary personal information.

Operational service providers. We may disclose information to vendors that provide information technology, website hosting, cloud storage, payment processing, shipping, fulfillment, customer support, analytics, security, and other services on our behalf.

Marketing and advertising partners. We may disclose information to partners that help us provide marketing services and advertising. Depending on where you reside, you may have the right to opt out of certain disclosures for targeted advertising.

Independent referral contractors. When you affirmatively request a referral, we may disclose the information described in the Optional Contractor Referral Program section to one matched environmental or remediation contractor.

Affiliates. We may disclose information to an affiliate or another entity within our corporate group, where applicable and permitted by law.

Environmental Testing Information
MycoTest provides testing services for samples collected from buildings, homes, properties, building materials, surfaces, dust, air, and other environmental sources. Our Services do not involve testing blood, tissue, saliva, genetic material, or other samples collected from a person.
Information collected or generated through the Services relates to the submitted environmental sample and, when provided, the property associated with that sample. It is not collected for the purpose of diagnosing, treating, or evaluating any person’s physical or mental health.
MycoTest is an environmental testing service and is not a healthcare provider. MycoTest does not provide medical testing, medical advice, diagnosis, or treatment. Environmental testing information is not intended to constitute a medical record, protected health information under the Health Insurance Portability and Accountability Act, or consumer health data.
Laboratory results apply only to the specific environmental sample submitted for analysis. They do not determine whether a person has been exposed to a substance, whether a person has a medical condition, or whether medical treatment or property remediation is necessary.
Artificial Intelligence Tools
MycoTest may use artificial intelligence and automated tools to support customer service, organize and summarize communications, assist with administrative tasks, improve website functionality, prevent fraud, and support internal business operations.
Depending on the task, these tools may process limited personal information, such as contact information, order information, customer communications, environmental testing information, or referral information. We limit the information provided to these tools to what is reasonably necessary for the applicable business purpose.
MycoTest does not use artificial intelligence to perform laboratory analysis, alter laboratory results, diagnose a medical condition, determine personal exposure, or determine whether property remediation is necessary. Laboratory results are generated by the applicable laboratory and are not replaced by an artificial intelligence generated conclusion.
When an outside artificial intelligence provider processes personal information on our behalf, we treat that provider as a service provider and require the information to be handled in accordance with applicable contractual, privacy, and security requirements. MycoTest does not intentionally provide personal information to an artificial intelligence provider for the provider to use in training a publicly available model unless we have disclosed that use and obtained any consent required by law.
Optional Contractor Referral Program
Program Overview
MycoTest offers an optional referral program that may connect customers with independent environmental or remediation contractors serving their area. Participation is optional, is not required to purchase a product, and does not affect the price paid to MycoTest, the laboratory analysis performed, or the results received.
A referral is not a determination that an inspection, remediation, repair, renovation, or other service is necessary.
How You Request a Referral
The referral option is not selected automatically. We will only make a referral if you affirmatively request one.
When the referral option is available, you may select it in your cart or through another referral request form. You may change your selection before completing checkout. Permission to receive telephone calls or text messages is presented as a separate choice and is not selected automatically.
Information We May Share
If you request a referral, MycoTest may provide one matched contractor with:

Your first and last name.

Your email address.

The address of the property tested or associated with the referral.

The type of environmental testing performed.
-
The result of the applicable environmental test.

Your telephone number, only if you separately authorize MycoTest to share it and authorize telephone or text contact.
MycoTest may provide the specific test result but will not provide the complete laboratory report unless you separately authorize that disclosure. MycoTest does not provide contractors with payment information, personal medical information, or information unrelated to the referral.
Information disclosed through the referral program may be used only to respond to your request and discuss potentially relevant environmental services. Our agreements with participating contractors require them to protect referral information and prohibit them from using it for unrelated advertising or transferring it to another business except as authorized by you or required by law.
Telephone and Text Communications
Permission to share your telephone number and receive telephone calls or text messages is requested separately from permission to disclose the other referral information identified above. Consent to calls or texts is optional and is not required to purchase a MycoTest product, receive laboratory results, or request a referral by email.
If you provide consent, MycoTest and the matched contractor may contact you at the number provided regarding the referral request. Communications may include calls made using automated dialing technology, prerecorded or artificial voice messages, and text messages. Message and data rates may apply.
You may withdraw consent to receive text messages by replying STOP. You may also withdraw communication consent by contacting MycoTest at support@mycotestkit.com or contacting the matched contractor directly.
Referral Compensation
MycoTest may receive compensation from contractors that participate in the referral program where permitted by law. This financial relationship does not increase the price of your MycoTest order.
You are not required to contact, hire, or enter into an agreement with a referred contractor. You remain free to obtain estimates from any provider you choose.
Depending on applicable law, disclosing personal information to a contractor in connection with compensation may be considered a sale of personal information. Where an applicable privacy law gives you the right to opt out of such a disclosure, withdraw consent, request access, or request deletion, MycoTest will honor that right.
Independent Contractors
Referred contractors are independent businesses. They are not employees, agents, partners, joint venturers, or representatives of MycoTest. MycoTest does not control a contractor’s inspections, recommendations, estimates, prices, contracts, services, work practices, warranties, or communications.
Any agreement for inspection, remediation, repair, renovation, or other services is entered into directly between you and the contractor. MycoTest is not a party to that agreement and is not responsible for the contractor’s acts, omissions, representations, services, pricing, workmanship, warranties, or compliance with applicable law.
Contractor Qualifications and No Endorsement
Licensing, certification, insurance, and permitting requirements vary by jurisdiction and service type. Contractors participating in the referral program are responsible for maintaining all credentials required for the services they offer.
Participation in the referral program does not constitute a guarantee or endorsement of a contractor’s services, recommendations, pricing, workmanship, warranties, insurance, licensing status, or continued qualifications. You are responsible for independently confirming that a contractor holds any license, certification, insurance, or permit required for the proposed work.
Testing and Referral Independence
The availability of a referral and any compensation MycoTest may receive do not affect the laboratory analysis or the results issued for a submitted sample. Independent laboratories analyze samples according to their applicable procedures without regard to whether a customer requests a referral.
MycoTest does not inspect the property, collect or supervise collection of the sample, determine the source or extent of a property condition, prepare a remediation protocol, prescribe corrective work, or determine whether remediation is necessary through the referral program.
Matching and Availability
MycoTest matches contractors based primarily on geographic service area, the general category of service requested, and contractor availability. A referral does not mean that MycoTest has independently evaluated your property, determined the work required, or concluded that the referred contractor is the only or best provider available.
Referrals are not available in every state or for every environmental service. Certain jurisdictions may restrict relationships between environmental testing services and remediation providers. MycoTest does not make referrals or accept referral compensation where MycoTest determines that the arrangement is prohibited. A referral is never guaranteed.
Withdrawal and Deletion Requests
You may cancel a referral request before MycoTest provides your information to a contractor by changing your selection before checkout or contacting support@mycotestkit.com.
If your information has already been provided to a contractor, withdrawal cannot reverse the original disclosure. However, MycoTest will stop making future disclosures based on that referral request. Where required by applicable law, MycoTest will notify the contractor of a verified withdrawal or deletion request.
You may also contact the matched contractor directly to request that it stop communicating with you or delete information in its possession.
Cookies and Similar Technologies
We and our service providers may use cookies, pixels, tags, software development kits, and similar technologies to operate the Services, remember preferences, understand how the Services are used, provide security, improve performance, and support marketing and advertising.
Your browser may allow you to remove or reject cookies. Blocking certain cookies may affect the functionality of the Services. Depending on where you reside, you may have additional rights concerning cookies, targeted advertising, or disclosures of personal information.
Relationship With Shopify
The Services are hosted by Shopify, which collects and processes personal information about your access to and use of the Services in order to provide and improve the Services. Information you submit through the Services will be transmitted to and processed by Shopify and may also be processed by third parties located in countries other than where you reside.
To help protect, operate, grow, and improve our business, we may use Shopify features that incorporate information obtained from your interactions with our store, other merchants, and Shopify. In these circumstances, Shopify may be independently responsible for its processing of personal information, including responding to requests concerning that processing.

Targeted Advertising and Data Sharing Choices

If you visit the Services with the Global Privacy Control preference signal enabled, we will treat the signal as an opt out request where required by applicable law. The request generally applies to the browser and device sending the signal. If Shopify can associate the signal with your account, the request may also be applied to that account. Other than legally recognized preference signals, we do not respond to browser “Do Not Track” signals.

The Services may contain links to websites or online platforms operated by third parties. If you follow a link to a third party service, you should review that party’s privacy and security practices and terms.
MycoTest does not control and is not responsible for the privacy, security, accuracy, completeness, or reliability of third party websites or services. The inclusion of a link does not by itself constitute an endorsement of the third party or its content.
Information you post in public or semi-public areas, including third party social networking platforms, may be visible and used by other people without limitation.
Children’s Information
The Services are not directed to children, and we do not knowingly collect personal information directly from children under 13 years of age. Products and Services must be purchased and used by an adult.
If you are a parent or legal guardian and believe a child provided personal information to us, please contact us so that we may review and, where appropriate, delete the information.
We do not knowingly sell or share the personal information of individuals under 16 years of age for targeted advertising.
Security
We maintain administrative, technical, and physical safeguards designed to protect personal information. However, no security measure is perfect or impenetrable, and we cannot guarantee absolute security.

Retention periods vary depending on the type of information, the reason it was collected, applicable laboratory and business record requirements, and legal obligations. When information is no longer reasonably necessary, we may delete, anonymize, or securely dispose of it.

We will respond within the time required by applicable law. Certain information may be exempt from a request, including information that we must retain to comply with legal obligations, complete a requested transaction, maintain security, resolve disputes, or establish or defend legal claims.
Communication Preferences
You may unsubscribe from promotional emails by using the unsubscribe link included in those emails. If you unsubscribe from promotional communications, we may continue sending nonpromotional communications concerning your orders, samples, laboratory reports, account, referrals, security, or other transactions.
Consent to receive referral related telephone calls or text messages may be withdrawn as described in the Optional Contractor Referral Program section.
International Data Transfers
We and our service providers may transfer, store, and process personal information outside the state or country where you reside. When required, we use legally recognized safeguards for international transfers, such as applicable standard contractual clauses or transfers to jurisdictions recognized as providing an adequate level of protection.
