Overview
This website is operated by MycoTest. Throughout these Terms of Service, “MycoTest,” “we,” “us,” and “our” refer to MycoTest. MycoTest offers this website, its online store, environmental test kits, equipment rentals, educational materials, laboratory-coordination services, referral features, and related services (collectively, the “Services”) subject to your acceptance of these Terms of Service (the “Terms”).
By visiting our website, placing an order, submitting a sample, renting equipment, using a result or report made available through the Services, or otherwise using any part of the Services, you agree to these Terms and to the policies incorporated into them by reference, including our Privacy Policy and Refund Policy. If you do not agree, do not use the Services.
These Terms apply to all users of the Services, including browsers, customers, purchasers, sample submitters, property owners, tenants, businesses, and contributors of content. If you use the Services on behalf of a business, property owner, client, or other person, you represent that you have authority to bind that person or entity to these Terms.
Our online store is hosted by Shopify Inc., which provides the ecommerce platform that enables us to offer products and Services to you.
1. Eligibility and lawful use
You must be at least the age of majority in your state or jurisdiction of residence to purchase or use the Services. You may not use the Services for an unlawful or unauthorized purpose or in violation of any applicable law, regulation, code, court order, lease, property right, or third-party right.
You may not introduce malicious code, interfere with the operation or security of the Services, impersonate another person, submit false information, or use the Services to collect information about another person unlawfully. We may refuse, suspend, or terminate access to the Services if we reasonably believe these Terms have been violated.
2. Nature of the Services
MycoTest provides do-it-yourself environmental testing products and coordinates access to independent laboratories for analysis of customer-collected samples from buildings, homes, properties, air, dust, or materials. Depending on the product purchased, testing may relate to substances or conditions such as mold, asbestos, lead, soot, smoke, or other environmental materials identified in the applicable product description.
Unless expressly stated otherwise in writing:

MycoTest is not a laboratory and does not itself perform the laboratory analysis.

MycoTest is not acting as an environmental assessor, inspector, industrial hygienist, engineer, architect, medical provider, or remediation contractor.

MycoTest does not visit or inspect your property, select sampling locations, collect or supervise your samples, determine the source or extent of a condition, or determine whether remediation or other work is legally required.

The Services are not a substitute for a professional inspection, statutory assessment, risk assessment, clearance examination, management plan, abatement design, medical evaluation, or other service that applicable law requires a licensed or certified professional to perform.
Product descriptions, instructions, educational content, customer-support communications, and laboratory reports are provided for their stated purposes only. They are not legal, medical, engineering, construction, or occupational-safety advice.
3. Environmental samples are not human health samples
MycoTest’s Services concern environmental samples collected from buildings, homes, properties, air, dust, or materials. We do not accept blood, tissue, saliva, urine, or other human biological specimens through these Services. Our Services are not designed to diagnose, treat, cure, mitigate, or prevent any disease or medical condition or to determine an individual’s exposure, health status, or medical risk.
Environmental test information is not, by itself, a medical diagnosis or a determination that a person has been exposed to a substance. If you have health symptoms or concerns, contact a qualified healthcare professional. If you believe there is an emergency or an immediate threat to health or safety, contact emergency services or the appropriate governmental authority.
4. Customer responsibility for sampling
You are responsible for deciding whether self-sampling is appropriate and lawful, obtaining permission to access and sample the property, selecting sampling locations, following all product and laboratory instructions, using appropriate protective measures, and complying with applicable laws and safety requirements.
By submitting a sample, you represent that:

You own the sample or have permission from the property owner or another authorized person to collect, possess, submit, and test it.

The sample was collected, packaged, labeled, documented, and shipped in accordance with the instructions supplied with the product and all applicable laws.

The information you provide about the sample, property, and order is accurate and complete.

Submitting the sample does not violate another person’s rights or any contractual, legal, evidentiary, or regulatory obligation.
Collecting environmental samples may disturb or release hazardous material. Do not collect a sample if doing so would be unsafe or unlawful. Suspect asbestos-containing material, lead-based paint, contaminated dust, fire residue, and other potentially hazardous materials may require sampling by a licensed or certified professional. You assume the risks associated with self-collection to the fullest extent permitted by law.
MycoTest may refuse, quarantine, return, or dispose of a sample that is leaking, hazardous, prohibited, improperly packaged, insufficient, unlabeled, inconsistent with the order, or otherwise unsuitable for handling or analysis. Additional fees or a replacement sample may be required.
5. Laboratory analysis and results
Samples may be analyzed by independent third-party laboratories. The applicable laboratory controls its analytical methods, quality procedures, accreditations, staffing, acceptance criteria, and reporting practices. Laboratory availability and methodology may vary by product, sample type, and jurisdiction.
A result applies only to the specific sample received and analyzed. It does not establish the condition of an entire room, structure, property, material system, or surrounding area. Conditions may vary by location and over time, and a negative or non-detect result does not guarantee that a substance is absent elsewhere or below every applicable threshold.
Results may be qualitative or quantitative depending on the test purchased. Detection limits, measurement uncertainty, sample condition, collection technique, cross-contamination, environmental conditions, shipping conditions, and incomplete or inaccurate customer information may affect a result. MycoTest does not independently verify the laboratory’s analytical findings and does not alter laboratory results.
Without limiting the foregoing:

An asbestos result for a customer-selected sample is not a comprehensive asbestos survey, inspection, operations and maintenance plan, or abatement clearance.

A lead result for a customer-selected sample is not a lead-based paint inspection, risk assessment, hazard screen, or clearance examination.

A mold result for a customer-selected sample is not a statutory mold assessment, an evaluation of the source or extent of moisture, or a determination of what remediation is necessary.

A soot, smoke, or fire-residue result does not determine the cause, source, extent, habitability, insurability, or appropriate restoration scope for a property.
You are responsible for obtaining advice from an appropriately qualified professional before making health, safety, occupancy, remediation, abatement, repair, insurance, litigation, real-estate, or regulatory decisions based on a result.
6. Turnaround times and delivery of results
Any processing, shipping, laboratory, or result-delivery time shown on the website or communicated by MycoTest is an estimate, not a guarantee. Timing may be affected by carrier delays, weekends and holidays, laboratory workload, sample condition, retesting, quality-control review, severe weather, emergencies, supply interruptions, or events beyond our reasonable control.
Estimated laboratory turnaround begins only after the correct laboratory receives and accepts a suitable sample with all required information. We are not responsible for delays caused by incorrect shipping, incomplete forms, insufficient samples, mislabeled samples, unpaid charges, or inaccurate contact information.
Results are generally delivered electronically to the email address or account associated with the order. You are responsible for providing accurate contact information, maintaining access to your account and email, and safeguarding result information after delivery.
7. Sample retention and disposal
Samples are consumable and may be altered or destroyed during analysis. Unless a different period is expressly stated by the applicable laboratory or required by law, neither MycoTest nor a laboratory is obligated to preserve, return, or make a sample available for future testing, litigation, insurance claims, or regulatory proceedings.
If you anticipate litigation, a regulatory matter, a property transaction, or another proceeding requiring formal evidence, chain-of-custody documentation, split samples, expert testimony, or specific sampling protocols, contact a qualified professional before collecting or submitting a sample. A standard consumer order may not satisfy those requirements.
8. Orders, billing, and account information
We may accept, reject, limit, or cancel an order, including orders that appear fraudulent, unlawful, commercially unreasonable, geographically restricted, or placed by unauthorized resellers. If we change or cancel an order, we may attempt to notify you using the email address, phone number, billing address, or account information provided with the order.
You agree to provide current, complete, and accurate purchase, billing, shipping, account, property, and sample information and to update that information when necessary. You represent that you are authorized to use the payment method submitted. You are responsible for all charges, taxes, duties, fees, and other amounts disclosed at checkout or otherwise associated with your order.
An order confirmation acknowledges receipt of your order but does not guarantee acceptance. We may correct pricing, product-description, availability, promotional, shipping, or other errors and may cancel an affected order, including after submission, subject to applicable law. Prices, products, geographic availability, and Services may change without notice.
Returns, refunds, replacements, and cancellations are governed by our Refund Policy, together with any product-specific terms displayed at purchase. Because testing products, laboratory services, shipping materials, and samples may be time-sensitive, consumable, personalized, or hazardous, some purchases may be nonreturnable or nonrefundable once shipped, opened, used, submitted, or processed, to the extent permitted by law and as disclosed in the applicable policy.
9. Shipping and risk of loss
Shipping dates and carrier estimates are not guaranteed. You are responsible for providing a complete and accurate delivery address and for following the return-shipping instructions applicable to your product. Unless required otherwise by law, risk of loss for physical products passes as provided by the applicable shipping terms and carrier rules.
You should retain tracking information and other shipment records. MycoTest is not responsible for samples or packages that are lost, delayed, damaged, misdirected, rejected, or delivered to the wrong location because instructions were not followed or incorrect information was supplied. If we provide a prepaid label, it may be used only for the identified sample, package, carrier, and destination.
10. Rental equipment
Additional terms shown on the product page, at checkout, or in rental instructions apply to any equipment rented through MycoTest. Unless stated otherwise, rental equipment remains the property of MycoTest or its supplier and may be used only for its intended purpose, in accordance with supplied instructions and applicable law.
You are responsible for safeguarding rental equipment while it is in your possession and returning it on time, complete, and in substantially the same condition in which it was received, ordinary wear excepted. You may be charged the amounts disclosed at purchase for late return, missing components, contamination, avoidable damage, loss, theft, or nonreturn. Deposits, authorizations, rental charges, and any refund of a deposit are governed by the terms disclosed for the rental and our Refund Policy.
Do not open, modify, repair, calibrate, misuse, or expose rental equipment to conditions outside its stated operating limits. Stop using equipment that appears damaged or unsafe and contact us promptly.
11. Optional contractor referral program
MycoTest may offer an optional program that connects customers with independent, licensed remediation or environmental-service contractors where permitted by law. Participation is not required to purchase a product, submit a sample, receive a result, or use any other Service, and it does not change the price of your test.
If you affirmatively opt in, MycoTest may share the referral information described in our Privacy Policy with one matched contractor serving your area. This may include your first and last name, email address, property address, the type of environmental test purchased, and the applicable test result. We share your phone number for referral contact only if you provide the separate authorization presented for phone or text communications. We do not share a complete laboratory report unless you separately authorize it. You may withdraw from the referral program as described in our Privacy Policy, although withdrawal cannot reverse a disclosure that occurred before we processed the request.
MycoTest may receive compensation from a contractor for a referral or resulting business where permitted by law. A referral may therefore be treated as a sale or other regulated disclosure of personal information under certain state privacy laws. Applicable notices and privacy choices are described in our Privacy Policy.
Contractors are independent businesses and are not employees, agents, joint venturers, or representatives of MycoTest. MycoTest does not control their inspections, recommendations, pricing, scheduling, contracts, licenses, insurance, workmanship, safety practices, representations, or regulatory compliance. Inclusion in the referral network is not an endorsement, warranty, certification, or guarantee. You are responsible for verifying a contractor’s current credentials, insurance, qualifications, references, pricing, and suitability and for reviewing any agreement before hiring the contractor.
Any agreement for inspection, remediation, abatement, repair, restoration, or other contractor work is solely between you and the contractor. MycoTest is not a party to that agreement and, to the fullest extent permitted by law, is not responsible for any act, omission, advice, charge, delay, dispute, injury, loss, or damage arising from a contractor or contractor service.
Referrals are not available in every state or for every hazard or service type. We may decline, restrict, or discontinue referrals when required by law, when no appropriate contractor is available, or for any other lawful reason. Opting in does not guarantee a referral or contractor response.
12. Communications and consent to calls or texts
By providing contact information, you authorize us to send transactional communications reasonably related to your order, sample, account, rental, results, support request, or requested Service. Message and data rates may apply.
Marketing calls or texts, and referral-related calls or texts where legally required, are subject to any separate consent language presented at the point of collection. Consent to receive marketing or automated communications is not a condition of purchase. You may opt out as described in the message or our Privacy Policy. Opting out of marketing does not prevent nonmarketing communications necessary to administer an existing transaction or respond to your request.
13. Artificial intelligence and automated tools
MycoTest may use artificial intelligence, machine learning, automation, or similar tools to support customer service, communications, administrative tasks, document organization, fraud prevention, and internal operations. These tools may assist personnel but do not perform laboratory analysis, change laboratory results, diagnose a medical condition, determine personal exposure, conduct a professional property assessment, or decide whether remediation is required.
AI-assisted content may contain errors and should not be treated as a substitute for the laboratory report, product instructions, these Terms, or advice from an appropriately qualified professional. Do not submit sensitive, confidential, privileged, or unnecessary personal information through free-form support fields or chat features. Our handling of personal information, including information processed through service providers, is described in our Privacy Policy.
14. Personal information
Our collection, use, disclosure, retention, and protection of personal information is governed by our Privacy Policy. The Privacy Policy includes additional information about environmental test information, laboratory service providers, artificial intelligence tools, the optional referral program, and applicable privacy rights.
15. Website content and intellectual property
The website and its text, graphics, branding, photographs, videos, product names, instructions, software, design, and other content are owned by or licensed to MycoTest and are protected by applicable intellectual-property laws. We grant you a limited, revocable, nonexclusive, nontransferable right to access and use the Services for their intended personal or internal business purpose.
Without our prior written permission, you may not reproduce, modify, publish, distribute, sell, sublicense, scrape, systematically extract, reverse engineer, or commercially exploit any part of the Services, except as applicable law expressly permits. You may retain and use your own order records and laboratory reports for lawful purposes.
16. User content and feedback
You retain ownership of information, photographs, reviews, messages, sample details, and other content you submit (“User Content”). You grant MycoTest a nonexclusive, worldwide, royalty-free license to host, reproduce, process, transmit, and use User Content as reasonably necessary to provide, secure, improve, and administer the Services and as described in our Privacy Policy.
If you voluntarily submit suggestions or feedback about the Services, you authorize us to use them without restriction or compensation, provided we handle associated personal information in accordance with our Privacy Policy.
You represent that your User Content is accurate, lawful, and does not violate another person’s privacy, intellectual-property, contractual, or other rights. We may remove content that we reasonably believe is unlawful, harmful, deceptive, infringing, or inconsistent with these Terms.
17. Third-party services, tools, and links
The Services may depend on or provide access to third parties, including Shopify, payment processors, carriers, laboratories, communications providers, analytics providers, equipment suppliers, and contractors. Third-party services may be governed by their own terms and privacy policies.
Links to third-party websites are provided for convenience and do not imply endorsement. We do not control and are not responsible for third-party websites, materials, products, services, availability, security, or practices. Your dealings with a third party are between you and that third party, subject to applicable law and any express obligations MycoTest undertakes in writing.
18. Prohibited uses
You may not use the Services or their content:

For an unlawful, fraudulent, deceptive, or unauthorized purpose.

To violate any international, federal, state, provincial, or local law or regulation.

To infringe or violate intellectual-property, privacy, publicity, contractual, property, or other rights.

To submit a sample you are not authorized to possess, collect, test, or ship.

To misrepresent a sample’s identity, origin, collection method, chain of custody, or relationship to a property or person.

To harass, threaten, defame, discriminate against, or harm another person.

To transmit malicious code or interfere with the integrity, security, or operation of the Services.

To spam, phish, scrape, crawl, data mine, or collect personal information unlawfully.

To circumvent access controls, security features, usage limits, or geographic restrictions.

To resell products, reports, or Services as your own, or represent yourself as MycoTest or an authorized MycoTest agent, without written authorization.
We may investigate suspected misuse and cooperate with lawful requests from courts, regulators, law enforcement, laboratories, carriers, or other appropriate parties.
19. Disclaimer of warranties
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES, WEBSITE, PRODUCTS, RENTAL EQUIPMENT, EDUCATIONAL CONTENT, REFERRAL FEATURES, AND THIRD-PARTY ACCESS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OR CONDITIONS OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, DURABILITY, NON-INFRINGEMENT, OR THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, TIMELY, OR ERROR-FREE.
MYCOTEST DOES NOT WARRANT THAT A CUSTOMER-COLLECTED SAMPLE IS REPRESENTATIVE OF A PROPERTY OR CONDITION; THAT A RESULT WILL IDENTIFY EVERY SUBSTANCE, HAZARD, SOURCE, OR AFFECTED AREA; THAT A RESULT WILL SATISFY A LEGAL, REGULATORY, INSURANCE, REAL-ESTATE, EMPLOYMENT, OR LITIGATION REQUIREMENT; OR THAT A REFERRED CONTRACTOR WILL CONTACT YOU OR PROVIDE SATISFACTORY SERVICES.
Nothing in these Terms excludes a warranty, remedy, or right that cannot lawfully be excluded.
20. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MYCOTEST AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, LICENSORS, SUPPLIERS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOSS OF USE, LOSS OF DATA, LOSS OF PROPERTY VALUE, BUSINESS INTERRUPTION, REPLACEMENT COSTS, OR SIMILAR LOSSES, ARISING OUT OF OR RELATED TO THE SERVICES, A PRODUCT, A SAMPLE, A RESULT, RENTAL EQUIPMENT, A DELAY, A REFERRAL, OR A THIRD-PARTY SERVICE, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE.
TO THE FULLEST EXTENT PERMITTED BY LAW, MYCOTEST’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO A PARTICULAR PRODUCT, ORDER, SAMPLE, RENTAL, OR SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID TO MYCOTEST FOR THAT PRODUCT, ORDER, SAMPLE, RENTAL, OR SERVICE GIVING RISE TO THE CLAIM.
These limitations apply regardless of the form of action, whether based in contract, warranty, tort, negligence, strict liability, statute, or another theory. They do not apply to liability that applicable law does not permit us to limit or exclude.
21. Indemnification
To the fullest extent permitted by law, you agree to indemnify, defend, and hold harmless MycoTest and its owners, officers, directors, employees, affiliates, agents, contractors, licensors, suppliers, and service providers from third-party claims, liabilities, losses, damages, judgments, penalties, costs, and reasonable attorneys’ fees arising out of or related to:

Your breach of these Terms or a policy incorporated by reference.

Your unlawful, unauthorized, negligent, or unsafe collection, handling, packaging, shipment, or use of a sample.

Your violation of a law, property right, contract, or third-party right.

False, incomplete, or misleading information you provide.

Your misuse of a product, result, report, rental item, referral, or other Service.
This section does not require you to indemnify a party for conduct to the extent such indemnification is prohibited by applicable law.
22. Service changes, suspension, and termination
We may modify, suspend, restrict, or discontinue any product, feature, referral program, geographic offering, or part of the Services, subject to applicable law. We are not liable for a modification, suspension, or discontinuance except for remedies expressly required by law or stated in an applicable policy.
These Terms remain effective until terminated. You may stop using the Services at any time. We may suspend or terminate your access if you violate these Terms, create risk or possible legal exposure, fail to pay amounts due, misuse the Services, or engage in conduct that threatens the safety or operation of the Services. Provisions that by their nature should survive termination—including payment obligations, intellectual-property provisions, disclaimers, limitations of liability, indemnification, and dispute provisions—will survive.
23. Governing law and venue
These Terms and any dispute arising out of or relating to the Services are governed by the laws of the State of Florida, without regard to conflict-of-law principles, except to the extent federal law applies or the law of your jurisdiction provides nonwaivable consumer protections.
To the extent a dispute may be brought in court, you and MycoTest consent to the exclusive jurisdiction and venue of the state and federal courts located in or serving Orange County, Florida, unless applicable law requires a different forum.
24. General provisions
These Terms and the policies and product-specific terms incorporated by reference constitute the entire agreement between you and MycoTest concerning the Services and supersede prior or contemporaneous communications on the same subject.
If a provision is found unlawful, void, or unenforceable, it will be enforced to the maximum extent permitted and the remaining provisions will remain effective. Our failure to enforce a provision is not a waiver. You may not assign your rights or obligations under these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or operation of our business, subject to applicable law.
We are not responsible for delay or failure caused by circumstances beyond our reasonable control, including severe weather, natural disasters, fire, epidemic, labor disruption, carrier interruption, laboratory closure, supply shortage, utility or internet failure, governmental action, civil disorder, or similar events.
25. Changes to these Terms
We may update these Terms from time to time by posting a revised version and updating the “Last updated” date. Changes apply prospectively when posted unless a different date is stated or applicable law requires additional notice. Your continued use of the Services after revised Terms take effect constitutes acceptance of the revised Terms. Material changes will be communicated as required by law.
